C3 : Mandatory mediation: can it ever work?
The importance of voluntariness in mediation is emphasized by some, but mandated mediation is a growing phenomenon. This session will examine the concept of “bona fide attempt to settle,” what that means in practice, and its implications for your clients’ interests. The session will canvas the areas of legal dispute in which mandated mediation has been imposed, and the success rates of those mediations – together with the relevance of legal representation at the time of and as a part of the mediation itself. Presenters will examine sanctions for non-participation, and whether exclusions from the litigation aftermath is either feasible or defensible in the context of the right to be heard.
