Even in the UK when one sees a clear unanimous Court of Appeal judgement on the prorogation of Parliament by three senior of the highest ability, set aside by a unanimous judgement of an 11 Judge Supreme Court one wonders what lies beneath the surface. We will look at this argument within the context of the strict separation of powers and the Latimer House principles. What impact will this struggle have on the promotion and protection of human rights and the rule of law in the Commonwealth?”
