C9 : Regulation of the legal profession: too much, by too many, for the benefit of too few?
Are the regulations applicable to practising lawyers outdated? irrelevant? overkill? Is self-regulation striking the right balance between protecting the public and allowing lawyers to practise in an affordable way without the constraints of over-reaching regulation? Are governing bodies expanding their remit and simply building regulatory empires? Jurisdictional differences in who bears the cost of over regulation will be part of the discussion. Presenters will canvas the issues of accountability of the regulators in cost/benefit terms; whether or not best practice is a hybrid of self regulation overseen by a government appointed person or body. This will necessarily mean an examination of the extent to which government regulation will threaten the independence of the legal profession itself – and the consequent effect upon the rule of law
